The Scottish regulations

What the law requires from 6 October 2026

The Investigation and Commencement of Repair (Scotland) Regulations 2026 set maximum statutory timescales for every report of damp or mould, in social and private rented homes.

10
working days
for a competent person to investigate once you are aware of damp or mould
3
working days
to give the tenant a written summary of the findings
5
working days
to start repairs where substantial damp or mould is found
20
working days
maximum for social landlords to complete the repair once started

Private landlords must complete repairs as soon as reasonably practicable. Summary only, based on Scottish Government guidance for landlords. It is not legal advice.

City & Guilds Assured
CPD Certified
Independently assured

Training from a body backed by City & Guilds

You are working with an organisation whose FODCS damp surveyor and FODCT damp proofing technician certifications are independently City & Guilds Assured, with damp surveyor training that is also CPD certified. For Scottish commissioning teams, that means your training partner is externally quality-checked, not self-appointed, the kind of assurance that stands up in procurement and audit.

Why Scottish housing providers are acting now

The clock starts the day a tenant reports damp or mould

The regulations set the speed. They do not give your team the competence. That gap is where the risk sits:

  • ✕Investigations by staff who cannot evidence competence
  • ✕Written summaries that do not stand up to scrutiny
  • ✕Misdiagnosis in solid stone, tenement and non-traditional stock
  • ✕Repeat repairs, complaints and compensation exposure
  • ✕Repairing Standard cases escalating to the First-tier Tribunal
Awaab’s Law Scotland

“Competent person” is now the phrase that matters

Every investigation must be carried out by a competent person, and the findings put in writing to the tenant within 3 working days. Confident diagnosis and clear, evidence-led reporting are what let you meet the timescales and defend your decisions. Our training is built to raise exactly that capability across your team.

Awaab’s Law training in Scotland: FAQs

When does Awaab’s Law apply in Scotland?+
From 6 October 2026, under the Investigation and Commencement of Repair (Scotland) Regulations 2026. It applies to social and private landlords from day one, covering homes under the Right to Repair Scheme or the Repairing Standard.
What are the timescales?+
A competent person must investigate within 10 working days of the landlord becoming aware of damp or mould. A written summary goes to the tenant within 3 working days of the investigation concluding. Where substantial damp or mould is found, repairs must start within 5 working days. Social landlords must then complete the repair within a maximum of 20 working days; private landlords as soon as reasonably practicable.
Will this training make us compliant?+
No training can guarantee compliance, and we will not claim it does. The programme is designed to support your compliance: it gives your team the diagnostic competence, reporting standard and process the regulations rely on, and the records to evidence it.
Do you deliver in Scotland?+
Yes. We deliver on-site at your offices or a regional venue anywhere in Scotland, with online or blended options where that suits your team.
Who is it for?+
Scottish councils, housing associations and RSLs, private landlords, letting and managing agents, and the repairs, maintenance and contractor teams who respond to damp and mould reports.
How much does it cost?+
Programmes are priced per organisation, based on team size, number of days and delivery format. You receive a fixed-price proposal after a short scoping call, with no obligation.
Why the Federation of Damp?+
We are the independent UK training and standards body for damp, mould and waterproofing: independent member vetting, a public register, a Code of Conduct, a complaints and redress process, and independence from manufacturers. Our FODCS and FODCT certifications are City & Guilds Assured.
